1. Pravo Unije ali pravo države članice, ki velja za upravljavca ali obdelovalca podatkov, lahko z zakonodajnim ukrepom omeji obseg obveznosti in pravic iz členov 12 do 22 in člena 34, pa tudi člena 5, kolikor njegove določbe ustrezajo pravicam in obveznostim iz členov 12 do 22, če taka omejitev spoštuje bistvo temeljnih pravic in svoboščin ter je potreben in sorazmeren ukrep v demokratični družbi za zagotavljanje:
1. Union or Member State law to which the data controller or processor is subject may restrict by way of a legislative measure the scope of the obligations and rights provided for in Articles 12 to 22 and Article 34, as well as Article 5 in so far as its provisions correspond to the rights and obligations provided for in Articles 12 to 22, when such a restriction respects the essence of the fundamental rights and freedoms and is a necessary and proportionate measure in a democratic society to safeguard:

(d) preprečevanja, preiskovanja, odkrivanja ali pregona kaznivih dejanj ali izvrševanja kazenskih sankcij, vključno z varovanjem pred grožnjami javni varnosti in njihovim preprečevanjem;
(d) the prevention, investigation, detection or prosecution of criminal offences or the execution of criminal penalties, including the safeguarding against and the prevention of threats to public security;
(e) drugih pomembnih ciljev v splošnem javnem interesu Unije ali države članice, zlasti pomembnega gospodarskega ali finančnega interesa Unije ali države članice, vključno z denarnimi, proračunskimi in davčnimi zadevami, javnim zdravjem in socialno varnostjo;
(e) other important objectives of general public interest of the Union or of a Member State, in particular an important economic or financial interest of the Union or of a Member State, including monetary, budgetary and taxation a matters, public health and social security;
(f) varstva neodvisnosti sodstva in sodnega postopka;
(f) the protection of judicial independence and judicial proceedings;
(g) preprečevanja, preiskovanja, odkrivanja in pregona kršitev etike v zakonsko urejenih poklicih;
(g) the prevention, investigation, detection and prosecution of breaches of ethics for regulated professions;
(h) spremljanja, pregledovanja ali urejanja, povezanega, lahko tudi zgolj občasno, z izvajanjem javne oblasti v primerih iz točk (a) do (e) in (g);
(h) a monitoring, inspection or regulatory function connected, even occasionally, to the exercise of official authority in the cases referred to in points (a) to (e) and (g);
(i) varstva posameznika, na katerega se nanašajo osebni podatki, ali pravic in svoboščin drugih;
(i) the protection of the data subject or the rights and freedoms of others;
2. Zlasti vsak zakonodajni ukrep iz odstavka 1 vsebuje posebne določbe vsaj, kjer je ustrezno, glede:
2. In particular, any legislative measure referred to in paragraph 1 shall contain specific provisions at least, where relevant, as to:

(73) Omejitve glede posebnih načel in pravic do obveščenosti, dostopa in popravka ali izbrisa osebnih podatkov, pravice do prenosljivosti podatkov, pravice do ugovora, odločitev, ki temeljijo na oblikovanju profilov, sporočanja o kršitvi varstva osebnih podatkov posamezniku, na katerega se nanašajo osebni podatki, in določenih s tem povezanih obveznosti upravljavcev se lahko uvedejo s pravom Unije ali pravom držav članic, če je to v demokratični družbi potrebno in sorazmerno zaradi zaščite javne varnosti, vključno z zaščito človeškega življenja, zlasti pri odzivu na naravne nesreče ali nesreče, ki jih povzroči človek, preprečevanja, preiskovanja in pregona kaznivih dejanj ali izvrševanja kazenskih sankcij, vključno z varovanjem pred grožnjami javni varnosti in njihovim preprečevanjem, ali kršitev etike za zakonsko urejene poklice, drugih pomembnih ciljev v splošnem javnem interesu Unije ali države članice, zlasti pomembnega gospodarskega ali finančnega interesa, vodenja javnih registrov iz razlogov splošnega javnega interesa, nadaljnje obdelave arhiviranih osebnih podatkov, da se zagotovijo specifične informacije v zvezi s političnim obnašanjem v nekdanjih totalitarnih državnih režimih, ali varstva posameznika, na katerega se nanašajo osebni podatki, ali pravic in svoboščin drugih, vključno s socialnim varstvom, javnim zdravjem in humanitarnimi nameni. Te omejitve bi morale biti skladne z zahtevami iz Listine in Evropske konvencije o varstvu človekovih pravic in temeljnih svoboščin.
(73) Restrictions concerning specific principles and the rights of information, access to and rectification or erasure of personal data, the right to data portability, the right to object, decisions based on profiling, as well as the communication of a personal data breach to a data subject and certain related obligations of the controllers may be imposed by Union or Member State law, as far as necessary and proportionate in a democratic society to safeguard public security, including the protection of human life especially in response to natural or manmade disasters, the prevention, investigation and prosecution of criminal offences or the execution of criminal penalties, including the safeguarding against and the prevention of threats to public security, or of breaches of ethics for regulated professions, other important objectives of general public interest of the Union or of a Member State, in particular an important economic or financial interest of the Union or of a Member State, the keeping of public registers kept for reasons of general public interest, further processing of archived personal data to provide specific information related to the political behaviour under former totalitarian state regimes or the protection of the data subject or the rights and freedoms of others, including social protection, public health and humanitarian purposes. Those restrictions should be in accordance with the requirements set out in the Charter and in the European Convention for the Protection of Human Rights and Fundamental Freedoms.
